1. Agreement and Eligibility
By accessing or using RentGiant, you agree to these Terms and to applicable law. If you use RentGiant for a business or organization, you represent that you are authorized to act for that organization.
You may not use RentGiant if doing so would violate applicable law or if your access has been suspended or terminated by RentGiant.
2. RentGiant Is a Marketplace
RentGiant provides technology that helps renters discover rental opportunities and helps landlords, property managers, apartment communities, real estate professionals, and other authorized providers publish and manage rental information.
Unless RentGiant expressly states otherwise for a specific transaction, RentGiant is not the landlord, tenant, property manager, owner, broker, lender, insurer, escrow agent, or party to a lease between marketplace users.
Review, moderation, account status, or publication of a listing does not constitute a guarantee, warranty, endorsement, inspection, or certification of a property, provider, renter, transaction, or representation.
3. Provider Responsibilities
Listing providers are responsible for having lawful authority to advertise the property or rental opportunity they submit.
Providers must keep listing information accurate and reasonably current, including pricing, availability, property characteristics, photos, contact information, fees, restrictions, and material terms.
Providers are responsible for their leases, screening practices, disclosures, licensing obligations, deposits, property condition, safety requirements, taxes, and compliance with federal, state, and local law.
4. Renter Responsibilities
Renters are responsible for evaluating listings and providers before entering a transaction. Renters should independently verify material information, inspect property when appropriate, review lease terms, and use reasonable care before transferring money or personal information.
RentGiant does not guarantee that a property remains available, that a provider will respond to an inquiry, or that a renter will qualify for a property.
5. Fair Housing and Nondiscrimination
Users must comply with applicable fair-housing and nondiscrimination laws. Listings, communications, screening practices, and marketplace activity may not unlawfully discriminate or express unlawful preferences, limitations, or exclusions.
RentGiant may remove content, restrict listings, suspend accounts, or take other appropriate action when discriminatory conduct or other violations are identified.
6. Accounts and Security
You are responsible for information submitted through your account and for maintaining the security of account-access links, passwords, and other credentials.
You must promptly notify RentGiant if you believe an account has been compromised or is being used without authorization.
You may not impersonate another person or organization, misrepresent your authority, or create accounts for fraudulent or abusive purposes.
7. Inquiries and Communications
When a renter submits an inquiry, RentGiant may provide the inquiry information to the provider responsible for the listing or to authorized members of that provider organization.
Users are responsible for the content and legality of communications they send through or as a result of RentGiant.
8. Fees and Paid Services
RentGiant may offer free and paid marketplace services. When a paid service is available, the applicable price, billing interval, included features, and other commercial terms will be presented before purchase.
No fee is owed merely because a feature or plan appears on the site if RentGiant has not actually accepted a paid transaction for that service.
Third-party payment processors may be used for paid services. Additional payment-processor terms may apply to those transactions.
9. Prohibited Conduct
You may not use RentGiant for fraud, unlawful discrimination, deceptive listings, phishing, malware, harassment, unauthorized data collection, circumvention of security controls, interference with the service, or any unlawful purpose.
You may not scrape, harvest, copy, or systematically extract marketplace data except with RentGiant authorization or where applicable law expressly permits the activity.
10. Content and Intellectual Property
You retain ownership of content you lawfully submit. By submitting content for marketplace publication, you grant RentGiant a nonexclusive license to host, reproduce, format, display, distribute, and use that content as reasonably necessary to operate, secure, promote, and improve the marketplace.
You represent that you have the rights necessary to submit the content and that its use by RentGiant as described here will not violate another person’s rights.
RentGiant branding, software, design, and original platform content remain the property of their respective owners and may not be used beyond the permissions provided by law or these Terms.
11. Third-Party Services
RentGiant may connect to third-party services such as payment processors, mapping services, analytics services, hosting providers, or external websites. RentGiant does not control every third-party service and is not responsible for third-party terms, availability, security, or content.
12. Service Availability and Disclaimers
RentGiant is provided on an as-available basis. To the fullest extent permitted by law, RentGiant disclaims warranties that the marketplace will be uninterrupted, error-free, completely secure, or that every listing, user, price, property, or representation is accurate.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
13. Limitation of Liability
To the fullest extent permitted by law, RentGiant and Midds Group LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the marketplace, loss of data, user conduct, listings, property transactions, or third-party services.
Any limitation applies only to the extent allowed by applicable law and does not limit liability that cannot legally be limited.
14. Indemnification
To the extent permitted by law, business users and listing providers agree to defend and indemnify RentGiant and Midds Group LLC against claims arising from their unlawful content, listings, property operations, violation of these Terms, or violation of another person’s rights.
15. Enforcement and Termination
RentGiant may review, reject, quarantine, unpublish, or remove content and may restrict or suspend accounts when reasonably necessary to enforce marketplace rules, protect users, investigate abuse, comply with law, or protect the platform.
Ending an account does not erase obligations or rights that by their nature should survive termination.
16. Changes to These Terms
RentGiant may update these Terms as the marketplace changes. The current version and effective date will be posted on this page. Material changes may also be communicated through the site or other reasonable means.
17. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.
